Santo Domingo, RD- Una computadora analizada luego de allanamientos de la operación Antipulpo arrojó un archivo que contiene anotaciones con la distribución de presuntos sobornos entregados por acusados en el caso Calamar a algunos funcionarios públicos, así como parte del dinero distribuido entre sus miembros.
De acuerdo con la solicitud de medida de coerción del caso Calamar, el 27 de marzo de 2021 la Procuraduría Especializada de Persecución de la Corrupción Administrativa (PEPCA) allanó la vivienda de Efraín Santiago Báez Fajardo, asistente del exdirector de Catastro Nacional, Claudio Silver Peña Peña, como parte de Antipulpo, donde encontraron la computadora que contenía un archivo de Excel denominado “Operación Bienes Nacionales: Listado Cesiones_19462”, datos que fueron posteriormente extraídos por el Instituto Nacional de Ciencias Forenses (Inacif).
Dentro del documento se indica a un “Claudio AV”, que el MP asume se trata del exdirector de Catastro, Claudio Silver Peña Peña, y a quien le habrían dado dos pagado en dos ocasiones: uno de 20 millones y otro por 5,380,000.
El documento de Excel “Relación de inversión en desarrollo de operación” sumaba la repartición de 296,795,531, según las autoridades.
Estas informaciones son corroboradas por los testimonios de los señoresRamón Emilio Jiménez Collie,Fernando Crisóstomo Herrera y Efraín Santiago Báez Fajardo, detalla el MP.
En el caso de Crisóstomo Herrara, él mismo entregó voluntariamente al Ministerio Público una serie de documentaciones, entre los que se encontró un cuadro en el cual se señala la cantidad de dinero recibido como soborno por parte de los funcionarios públicos involucrados en el desfalco cometido a través del pago por las expropiaciones.
En total el imputado Claudio Silver Peña Peña habría recibido 60,280,000 de pesos.
Acusaciones
El 15 de septiembre de 2014 Claudio Silver Peña Peña fue designado como director general de Catastro Nacional, mediante decreto del expresidente Danilo Medina.
Estuvo en el cargo hasta el 16 de septiembre de 2020. Lo cierto es que antes de asumir como director, era el subdirector de Catastro, por lo que conocía cómo se manejaba la institución, dice el documento.
De acuerdo con las acusaciones, Claudio Silver Peña Peña realizaba avalúos irregulares que servían como base para fijar los precios en los acuerdos transaccionales de compra de terrenos expropiados, permitiendo con esto la distracción de fondos públicos en beneficio del entramado investigado con el caso Calamar.
“Asimismo, el imputado Claudio Silver Peña, con una intención dolosa, realizaba cálculos desiguales e infundados en algunos avalúos, estableciendo que todas las porciones dentro del perímetro de una inmensa parcela poseen el mismo valor, sin importar que haya terrenos que se encontraban en el borde del mar, otros en la carretera y otros en condiciones inhóspitas”, esto con la finalidad de sacar la mayor cantidad de dinero del Estado para él y los demás miembros de la estructura criminal.
El expediente indica que la participación del imputado Claudio Silver Peña Peña fue una pieza clave fundamental para la ejecución de las actividades delictivas de la organización criminal, bajo las directrices del imputado Donald Guerrero, ex ministro de Hacienda, quien era su jefe inmediato, según el organigrama de la institución.
“Es por esto por lo que, actuando en calidad de funcionario público de primer nivel, en coalición de funcionarios de igual y mayor jerarquía, tenían, como miembro de esta estructura criminal, la misión de utilizar sus funciones para realizar actos de corrupción consistentes en prevaricación, concusión, soborno, estafa y el desfalco en contra del Estado”, señala.
Bienes inmuebles y propiedades
Durante el periodo como director general de Catastro, entre 2014 y 2020, Claudio Silver Peña Peña incrementó su patrimonio y posee un vehículo marca Toyota, modelo Prado VXL 4WD de 2018; vehículo Hyundai Tucson 2014 y un apartamento en el Condominio Residencial Larissa VIII, en Santo Domingo Este.
Además otro apartamento esta vez en la Torre Larissa IX, Santo Domingo Este, donde reside actualmente; y una casa de dos niveles, en el sector Miramar, en el Distrito Nacional.
“Lo que pone en evidencia que el imputado Claudio Silver Peña Peña, tomando en cuenta las circunstancias objetivas del tipo, actuó de manera dolosa en sus maniobras de lavado, al poseer, adquirir, ocultar y encubrir bienes de procedencia ilícita, producto del desfalco y estafa al Estado dominicano. Con el agravante de que estas acciones fueron realizadas durante el ejercicio de sus funciones públicas”, describe el expediente.
