Jean Alain obligó a contratistas a comprar material a CEMEX Dominicana.

Una de las supuestas irregularidades cometidas en la construcción del Centro de Corrección y Rehabilitación La Nueva Victoria, señaladas por el Ministerio Público en el expediente acusatorio del caso Medusa,es que el exprocurador creó un esquema para obtener comisiones por las ventas de cemento asfaltico, hormigón y agregados, obligando a cinco contratistas a comprar de forma “exclusiva” estos materiales a la empresa Cemex, una multinacional mexicana con oficinas en el país Dominicana.

 

Las empresas obligadas fueron Consorcio Construcción y Transporte de Prefabricados EEC; Constructora Pablo Yarull & Asociados, S.R.L.; Mac Construcciones, S.R.L.; Consorcio Remix y Constructora Woxxen, S.R.L.

Los fiscales señalan al empresario Enrique Bonetti Galván como la persona que le propone a Jean Alain Rodríguez comprar el material a través de la compañía Materiales de Construcción LNV, S.R.L., de su propiedad, “como una actividad común de comisiones en la que este obtendría un monto en pesos por cada metro cubico que CEMEX Dominicana, S.A., vendiera”. El precio de Cemex era de RD$ 5,500 el metro cúbico.

La Procuraduría, en su escrito de acusación, indica que Cemex Dominicana le pagó a esta empresa, Materiales de Construcción LNV, RD$ 12,908,197.00. “La cantidad obtenida por el contrato de comisión fue dividida entre Jean Alain Rodríguez Sánchez y Enrique Bonetti Galván”, dice el documento.

Materiales de Construcción LNV fue constituida el 13 marzo del 2019, “prácticamente al iniciarse la construcción del CCR La Nueva Victoria”.

 

¿Cómo se ejecutó el plan para obligar a los contratistas?

Los fiscales indican que por instrucción del acusado Jonnathan Joel Rodríguez Imbert, la también acusada Jenny Marte Peña le informa a los contratistas que debían comprarles todo el hormigón a Cemex y los convoca a una reunión en la empresa CEMEX Dominicana, S.A., ubicada en la plaza comercial Acrópolis. La misma se celebró el 19 de marzo del 2019, entre las 04:00 hasta las 05:20.

A ella asistieron los representantes de las cinco empresas y Jonnathan Joel Rodríguez Imbert, en representación de la Procuraduría, quien “se presentó siendo las 16:53 y se retiró de la torre empresarial siendo las 17:50”, de acuerdo a una comunicación enviada al Ministerio Público por Condominio Centro Comercial Acrópolis.

 

Algunas de las empresas, como citan en el caso del Consorcio Remix-Rotilla, se opususieron a este trato. Esta empresa alegaba que tenía su propia hormigonera, que le ayudaba a reducir costos y que también le suplía hormigón a Constructora Woxxen a RD$ 4,800 por metro cúbico, más barato que el de Cemex. Al final se “impuso” la petición que hacía Jean Alain y su equipo.

El Ministerio Público establece que el 26 de abril del año 2020, Jean Alain Rodríguez utilizando una flota de la compañía DOMICEN S.A.,asignada a la empresa Jurinvest, S.R.L., (quien es investigada por una asesoría pagada y no ejecutada), contacta por WhatsApp al principal ejecutivo de CEMEX en República Dominicana, José Antonio Cabrera Guerra, a través de la flota perteneciente a la empresa CEMEX Dominicana.

En las conversaciones obtenidas, luego que Cemex entregara de forma voluntaria el teléfono al Ministerio Público, se evidencia cómo Jean Alain Rodríguez solicita de forma directa cantidades de hormigón a la empresa CEMEX Dominicana, S.A.

 

El expediente contiene una serie de conversaciones sostenidas entre Jean Alain Rodríguez y José Antonio Cabrera Guerra.

De igual forma, Jean Alain Rodríguez Sánchez exigía más producción sin importar los costos, a pesar de que quien manejaba la operatividad y podía hacer solicitudes eran los contratistasde los diferentes cuadrantes de la Nueva Victoria, lo que beneficiaba a la empresa comisionista Materiales de Construcción LNV.”, dice el expediente.
