Consultor Jurídico resalta disposición del diálogo para consolidar instituciones y órganos de control estatal

Santo Domingo. –El Consultor Jurídico del Poder Ejecutivo, Antoliano Peralta, aseguró hoy que uno de los principales compromisos del gobierno es lograr consolidar la democracia y el principio de separación de poderes, que garantice la sistematización de los órganos de control del Estado dominicano.

 

Sobre el particular, manifestó que, para ello, es importante la contribución de los principales actores de la sociedad civil y sus instituciones.

El funcionario dijo que el objetivo de la sesión es producir un espacio de diálogo respecto al anteproyecto que declara la necesidad de la reforma constitucional, como una de las 14 iniciativas normativas que se conocieron hoy.

 

“Es en función de esto, que por ejemplo para el fortalecimiento de la justicia proponemos excluir al Procurador General de la República de la integración del Consejo Nacional de la Magistratura a la vez, que proponemos una renovación gradual los jueces de las altas cortes y nuevos requisitos para la elección de éstos a los fines de incidir en la despolitización de esos órganos”, expuso el Consultor jurídico del Poder Ejecutivo.

 

Peralta apuntó que igual ocurre con el interés de garantizar la independencia plena del Ministerio Público, donde proponen que el Procurador General de la República sea designado de conformidad con la ley a través de un proceso transparente y diferente al método actual que lo deja a voluntad unilateral del presidente de la República.

 

También, agregó, que pueda ser interpelado este funcionario por las Cámara Legislativas en ocasiones de ejercicio de sus funciones.

 

Peralta explicó que el objetivo de la reunión es lograr una interacción entre el gobierno y la sociedad que permita alcanzar un consenso sobre la actualización de normativas institucionales.

 

Consolidar la Democracia

 

“Uno de los compromisos del gobierno es lograr consolidar la democracia y el principio de separación de poderes, lo cual está convencido de que se puede alcanzar principalmente a través del fortalecimiento sistemático de los órganos de control del Estado”, añadió.

El Consejo Económico y Social (CES) efectuó la tercera reunión de la Mesa Temática de Transparencia e Institucionalidad, en el marco de la convocatoria Presidencial del Diálogo para la Reforma y Fortalecimiento Institucional y la Gestión Eficiente del Estado.

 

La actividad, realizada en la Pontificia Universidad Católica Madre y Maestra (PUCMM), recinto de Santo Domingo, delineó aspectos de una propuesta de la Reforma Constitucional en beneficio de los diferentes sectores del país.

 

“Para consolidar el ejercicio democrático, proponemos unificar las elecciones y eliminar el arrastre electoral en todos los niveles de votación, así como facilitar el uso de la iniciativa legislativa tanto por los ciudadanos en sentido general, a través de la iniciativa legislativa popular, como por algunos órganos constitucionales que actualmente están excluidos de dicha dinámica”, indicó.

 

Peralta dijo, que en el caso de la legislación popular el actual requisito del 2% de los distritos en el registro de electores equivale aproximadamente a 200 mil personas, lo cual el gobierno propone reducirlo a 25 mil ciudadanos.

 

En el caso de los órganos constitucionales, plantea que si la Suprema Corte de Justicia y la Junta Central Electoral, tienen iniciativas legislativas en sus respectivas materias, también la puedan tener otros órganos como por ejemplo, el Tribunal Constitucional.

 

Asimismo, Antoliano Peralta, expresó que para alcanzar un objetivo de esta naturaleza, “es necesario reformar la Constitución puntualmente”, por ser la base normativa suprema de todas las instituciones mencionadas cuya independencia y eficaz funcionamiento reclama y necesita la sociedad.

 

Expuso que esta propuesta no pretende restar méritos a la Constitución vigente ni al esfuerzo realizado hace más de una década para su modificación más significativa en los últimos años.

 

“Esta reforma busca plasmar lo que hemos aprendido en estos 12 años”, dijo el Consultor jurídico del Poder Ejecutivo.

 

Agregó que dicha reforma constitucional no se trata de una coyuntura política o para beneficio del gobierno o un sector de este.

 

“En tal sentido, es importantísimo aclarar que, contrario a como ha ocurrido en ocasiones anteriores, esta reforma no versa sobre la reelección presidencial ni aumenta en ninguna medida las atribuciones actuales del Poder Ejecutivo, así como tampoco le crea al presidente de la República algún escenario privilegiado en ocasión de su actual mandato constitucional”, precisó.

 

En ese sentido, enfatizó que la Reforma Constitucional lo que procura es restarle restarle poder al Poder Ejecutivo y redistribuirlo entre los demás poderes del Estado y los propios ciudadanos.

 

Adiciona, que a través de disposiciones transitorias se estarían difiriendo los efectos de aquellas modificaciones que puntualmente pudiesen alterar el escenario político actual como, por ejemplo, la unificación de las elecciones; de esta forma, las elecciones a celebrarse en el año 2024 seguirían rigiéndose por las reglas de la actual Constitución (incluso luego de aprobada la reforma).

 

Los Tres Pilares

 

Peralta sostuvo que el objeto de la Reforma Constitucional propuesta descansa entonces en tres pilares:

 

A) Robustecer el sistema de controles de los poderes del Estado y los órganos constitucionales.

 

B) Eficientizar los procesos propios del Estado y la Administración Pública.

C) Consolidar el ejercicio democrático, a través de mejoras puntuales al régimen electoral y el procedimiento legislativo.

 

Con tales objetivos se proponen las siguientes modificaciones al texto de la Constitución:

 

1. Modificaciones al proceso de formación de leyes.

2. Modificaciones al Ministerio Público.

3. Modificaciones a la Procuraduría General Administrativa.

4. Modificaciones al Consejo Nacional de la Magistratura.

5. Modificaciones a la Suprema Corte de Justicia y el Poder Judicial.

6. Modificaciones al Tribunal Constitucional.

7. Modificaciones al régimen electoral, la Junta Central Electoral y el Tribunal Superior Electoral.

8. Modificaciones al régimen de control de los fondos públicos, la Cámara de Cuentas y la Contraloría General de la República.

 

Finalizó que la forma como cualquier otra deberá someterse al procedimiento contemplado en la constitución en sus artículos 167 y siguientes sin detrimentos de pasos previos.

Acompañaron al consultor Jurídico del Poder Ejecutivo la directora general de Ética e Integridad Gubernamental (DIGEIG), Milagro Ortiz Bosch; el subconsultor Jurídico del Poder Ejecutivo, Pedro Montilla; el ministro de la Juventud, Rafael Feliz; el viceministro de reforma y modernización del Estado del Ministerio de Administración Pública (MAP), Gregorio Montero.

 

Igualmente, representantes de instituciones políticas, sociales, empresariales y sindicales.
