SANTO DOMINGO.-La Federación Nacional de Trabajadores del Transporte Social Cristianos (Fenattransc), le solicitó a la Procuraduría Especializada de Persecución contra la Corrupción Administrativa (Pepca), que cite e interrogue al expresidente Danilo Medina para que explique el uso dado en sus gobiernos a los recursos recaudados para sustituir la flotilla vehicular del transporte de pasajeros y de cargas.
Mediante instancia motivada y depositada en la Pepca por el abogado Carlos Manuel Mesa, Fenattransc alega que Medina y otros exfuncionarios están siendo demandados por el presunto mal uso que se le dio a los referidos fondos y por eso tienen que ser interrogados.
Además del exmandatario, los transportistas demandantes también señalan a los exministros de la Presidencia, de Hacienda y Administrativo de la Presidencia, Gustavo Montalvo, Donald Guerrero y José Ramón Peralta, respectivamente, así como el exadministrador del Banreservas, Simón Lizardo.
El líder de la Fenattransc, Mario Díaz, explicó que el artículo 20 de la Ley 253-12 fija un impuesto de dos pesos a la gasolina y el gasoil premium, con un 75 % para mantenimiento de la red vial y un 25 % para la renovación del parque vehicular, «al parecer fueron dilapidados para beneficio de estos exfuncionarios del pasado Gobierno».
Al ser entrevistado en un programa de televisión, Díaz recordó que en el 2016, con cuatro años de recaudaciones por esa Ley, los transportistas dominicanos solicitaron a través de la Fenattransc, a Gustavo Montalvo la información sobre esos recursos, «sin obtener respuestas».
Entonces acudieron al Tribunal Superior Administrativo, donde “al parecer por error, los abogados de esos exfuncionarios depositaron un documento que evidencia que Gustavo Montalvo le solicitó al exministro de Hacienda que transfiriera esos recursos a la cuenta del Ministerio Administrativo de la Presidencia, para que el entonces presidente Danilo Medina pudiera utilizarlos a su entera discreción».
La Ley 253-12 establece en su artículo 20 párrafo tres, que esos recursos deben ser utilizados únicamente y exclusivamente para la renovación de la flota vehicular del transporte público de pasajeros y de cargas de nuestro país, o sea, que esos recursos no podían ser solicitados para que Medina los destinara a otros capítulos, aun hayan sido establecidos en el Presupuesto Nacional y mucho menos en asuntos políticos de su partido y de sus candidatos, como presumimos que fueron utilizados esos recursos”, ”, afirmó el transportista.
El caso llegó al Tribunal Constitucional, que en diciembre del 2018 ordenó que el Instituto Nacional de Tránsito y Transporte Terrestre (Intrant) pusiera en ejecución el plan de renovación vehicular, «sentencia que fue desacatada por el entonces ministro Montalvo y por órdenes del entonces presidente de la República».
“Cuando viene el cambio de Gobierno y asume Luis Abinader, resulta que no hay un centavo en ninguna cuenta del Gobierno y es cuando decidimos interponer una querella ante la Pepca, el 23 de mayo del 2021, la cual no prosperó; nos quedamos esperando a que nos citaran y previo al conocimiento del caso Calamar fue cuando decidimos reintroducirla y la magistrada Yeni Berenice ordenó que se realizara una investigación al respecto”, informó Díaz.
Es así que esta querella se suma a la investigación que se les sigue a 20 exfuncionarios del Gobierno de Danilo Medina, que fueron apresados mediante la operación Calamar.
