Poder Ejecutivo deposita en Congreso Nacional proyectos de leyes: hidrocarburos, fideicomisos públicos y contrataciones públicas

El presidente Luis Abinader, por intermedio del Consultor Jurídico del Poder Ejecutivo, Antoliano Peralta, depositó tres proyectos de ley, tal como lo anunció ayer en su discurso de rendición de cuentas.

Las iniciativas legislativas impulsadas por el jefe de Estado son el proyecto de ley que reorganiza el sector de hidrocarburos en la República Dominicana, el proyecto de ley general de contrataciones públicas y el proyecto de ley que establece el régimen aplicable para la regulación de los fideicomisos públicos en la República Dominicana.

Las indicadas propuestas normativas son el resultado de un largo proceso de consultas y análisis con los principales actores de los sectores bajo regulación.

Al ser recibidos por el presidente del Senado, Eduardo Estrella, este precisó que las piezas serán priorizadas e introducidas en las próximas sesiones de las comisiones de Hacienda y Asuntos Energéticos por ser de alto interés para la población dominicana y el Poder Ejecutivo.

Asimismo señaló que escucharán a los diferentes sectores de la vida nacional para que estos proyectos puedan salir lo más enriquecidos posibles.

El proyecto de ley que reorganiza el sector de hidrocarburos en la República Dominicana tiene por objeto establecer un modelo de reorganización integral del sector de los combustibles en la República Dominicana, por lo que introduce modificaciones a la ley núm. 112-00, del 29 de noviembre de 2000, que establece un impuesto al consumo de combustibles fósiles y derivados del petróleo.

El prolongado contexto internacional de alza del petróleo obliga al Estado dominicano a adecuar la legislación vigente en materia de hidrocarburos, a fin de incorporar herramientas normativas acorde con esta nueva realidad.

En ese orden, esa iniciativa establecerá, en la metodología de fijación de precios de los combustibles, elementos de costos basados en criterios de eficiencia y mejores prácticas.

“Hemos dado el paso de traer la modificación y crear la oportunidad de que se debata y ver qué dice la mayoría y dónde se tiene que modificar”, indicó el ministro de Industria y Comercio, Víctor -Ito- Bisonó.

También se agregó que entre las modificaciones que introduce esta pieza se establecen ajustes quincenales a los precios de los combustibles, en vez de semanales, se crean mecanismos para crear fondos para tiempos de inestabilidad; se busca automatizar las estructuras y procesos y se desmontan las exoneraciones de combustibles para sistemas de energía que no estén interconectados.

Además, incorporará herramientas que permitan mitigar el impacto de las alzas de los precios de los combustibles en el mercado internacional, así como fiscalizar y monitorear las actuaciones de la Administración Pública y sujetos regulados.

Proyecto de Ley para la regulación de Fideicomisos Públicos

Por su parte, el proyecto de ley que establece el régimen aplicable para la regulación de los fideicomisos públicos en la República Dominicana tiene por finalidad establecer una normativa para la regulación del fideicomiso público, su organización, estructura y funcionamiento, así como su capacidad legal para administrar recursos públicos y proveer, gestionar o ejecutar obras de infraestructura o servicios de interés colectivo.

Las disposiciones establecidas en este anteproyecto son de aplicación obligatoria para las entidades públicas que estructuren y constituyan algún fideicomiso público.

Proyecto de Ley General de Contrataciones Públicas

En lo que respecta al proyecto de ley general de contrataciones públicas se persigue hacer más transparentes y ágiles los procesos de contrataciones públicas.

Esta propuesta tiene por objeto establecer el régimen jurídico general de la contratación pública, mediante la determinación de los órganos, principios, procedimientos y reglas que aplican a esta, con la finalidad de garantizar una eficiente utilización de los fondos públicos y una mayor satisfacción de las necesidades de interés general y de los derechos fundamentales de las personas, aplicando de manera transversal criterios que aseguren el desarrollo sostenible y fomenten el uso de la tecnología.

Entre las novedades que incluye la pieza figuran los convenios marco, que son los acuerdos resultantes del procedimiento de selección de proveedores, gestionado y ejecutado por la Dirección General de Contrataciones Públicas para la adquisición de bienes y servicios comunes y estandarizados de uso frecuente por las instituciones públicas, en los cuales se establecerán precios y condiciones de entrega durante un tiempo definido.

De igual modo, se fortalecen los principios del sistema de contratación pública, incluyendo juridicidad, inclusión, debido proceso, objetividad, imparcialidad, idoneidad, planificación, sostenibilidad, favorabilidad de la producción nacional y favorabilidad del desarrollo local.

Se establece prohibición absoluta para la contratación con el Estado para el presidente, vicepresidente y sus parientes por consanguinidad o por afinidad hasta el segundo grado (hijos, cónyuge, padres, suegros, yernos y nueras, abuelos, hermanos, nietos y cuñados).

Entre otros temas innovadores, este proyecto de ley establece modalidades o procedimientos de contratación atendiendo a la cuantía y al objeto y las características de la prestación.

Los tipos de procedimiento serán, licitación pública, licitación pública abreviada, contratación simplificada, sorteo de obras, subasta inversa, contratación menor y contratación sujeta a umbral. De estos, la principal novedad es la licitación pública abreviada, que establece un plazo reducido para la contratación de bienes y servicios comunes y estandarizados.

En lo referente a las mipymes, la ley incrementaría de un 20 a un 30 el porcentaje del presupuesto reservado a contrataciones dirigidas a este sector empresarial y, dentro de este, de un 5 a un 10 % para las mipymes mujeres.

 

También estuvieron presentes el subconsultor jurídico Pedro Montilla; los senadores Yvan Lorenzo, Ricardo de los Santos, presidente de la comisión de asuntos energéticos y Faride Raful, presidenta de la comisión de Hacienda; así como otros funcionarios relacionados a los citados proyectos.
