Funcionario que viole ley de Extinción de Dominio quedará inhabilitado por cinco años y podría ir a prisión.

El servidor o funcionario público que emita una decisión, resolución, solicitud, o ejecute un acto contrario a Ley de Extinción de Dominio, incurrirá en prisión de 2 a cinco años y multa de 50 a 400 salarios mínimos del sector público.

 

De acuerdo al artículo 101, sobre prevaricato por acción, además quedará inhabilitado para el ejercicio de derechos y funciones públicas de cinco años y será responsable a título personal por los daños y perjuicios que su conducta genere.

Asimismo, el artículo 102 de la referida Ley aprobada por el Senado de la República, sobre prevaricato por omisión, el servidor público que omita, retarde, rehuse o deniegue un acto propio de sus funciones, o incurra en desacato de una decisión judicial emitida en el marco de esta ley, incurrirá en prisión de 2 a cinco años.

Igualmente, multa de 50 a 400 salarios mínimo del sector público, e inhabilitación para el ejercicio de derechos y funciones públicos de 5 años, también será responsable a título personal por los daños y perjuicios que su conducta genere.

Será sancionado además,  conforme al artículo 103, de la referida ley en cuanto a violación a reglas de administración, el servidor o funcionario público, o aquel que sin serlo haya sido contratado o recibido atribuciones dentro del marco de esta ley, que haya dado un uso inadecuado, descuidado o abusivo a los bienes sometidos a procedimiento de extinción de dominio, o que los haya distraído para su uso personal o en beneficio de terceros.
