El tribunal presidido por Doris Pujols Ortiz e integrado por Rafael Báez y Carmen Mancebo anuló la decisión que descargó a Rafael Antonio Peña, el coronel Carlos Picini Núñez y el empresario Daniel Aquino Hernández.
El tribunal dispuso que el expediente sea enviado a primera instancia para que apoderen un tribunal que conozca el juicio desde cero.
Los jueces dispusieron que la audiencia sea conocida por un tribunal diferente al Tercer Tribunal Colegiado del Distrito Nacional que pronunció el descargo de los implicados.
El tribunal tomó la decisión al acoger un recurso de apelación interpuesto por Wilson Camacho, titular de la Procuraduría Especializada de Corrupción Administrativa (Pepca).
El Ministerio Público acusó a los procesados de recibir los US$3.5 millones que la Empresa Brasileira de Aeronáutica (Embraer) admitió haber dado en el país, dinero entregado para ser escogida como la suplidora de ocho aviones de combate, denominados Super Tucano.
La sentencia de descargo emitida en primer grado se produjo en mayo del año 2022, y en ella se absolvió al mayor general retirado Pedro Rafael Peña Antonio, exministro de Defensa; al coronel Carlos Piccini Núñez, exdirector de proyectos especiales de la Fuerza Aérea Dominicana (FAD), y al empresario Daniel Aquino Hernández. Además, fueron descargadas las empresas imputadas 4D Business Group y Magycor.
