Presidente Abinader emitió el Reglamento de Aplicación de la Ley 167-21 de Mejora Regulatoria y Simplificación de Trámites.

Santo Domingo.- El presidente Luis Abinader, a través del decreto núm. 486-22, del 24 de agosto de 2022, dictó el Reglamento de Aplicación de la Ley núm. 167-21, de Mejora Regulatoria y Simplificación de Trámites.

 

Este reglamento regula de manera más detallada los procesos para el dictado de normas regulatorias por parte de las distintas dependencias del Poder Ejecutivo.

 

Dentro de sus novedades se destaca la configuración y desarrollo del análisis de impacto regulatorio, que permitirá evaluar los efectos positivos o negativos que puedan producir las normas, no solo antes de su eventual entrada en vigencia, sino también durante su aplicación.

 

Además, el reglamento reconfigura el proceso de consulta pública, que venía rigiéndose por el decreto 130-05 que aprueba el Reglamento de la Ley General de Libre Acceso a la Información Pública.

 

En ese sentido, las propuestas de regulaciones económicas y sociales significativas serán sometidas a un proceso de consulta pública de 45 días hábiles, mientras que las demás se regirán por un plazo de 20 días hábiles.

 

El reglamento fue producto de un trabajo conjunto del Ministerio de Administración Pública (MAP), en su calidad de órgano de supervisión y coordinación de la mejora regulatoria y simplificación de trámites, y de la Consultoría Jurídica del Poder Ejecutivo.

 

A la vez que fue objeto de un amplio proceso de socialización con los actores relevantes, para lo cual fue sometido del 1 al 28 de junio de 2022 al procedimiento de consulta pública previsto en la referida ley núm. 167-21.

 

El dictado de este reglamento se enmarca dentro del Plan General para la Reforma y Modernización de la Administración Pública trazado en el decreto núm. 149-21, bajo la coordinación del MAP.
