Jueza autoriza a la Pepca obtener información financiera respecto investigación a Donald Guerrero.

La jueza coordinadora de los juzgados de la Instrucción del Distrito Nacional autorizó a la Procuraduría Especializada de Persecución de la Corrupción Administrativa (Pepca), para la obtención de informe financiero respecto a una investigación abierta en contra del exministro de Hacienda, Donald Guerrero Ortiz.

La magistrada Kenya Romero, ordenó a las Superintendencias de Bancos, de Valores, de Seguro, la Dirección General de Impuestos Internos (DGII), el Instituto de Desarrollo del Crédito Cooperativo (Idecoop) proveer al director del Pepca, Wilson Camacho, los reportes e informes de los productos financieros, así como todas las informaciones tributarias.

La jueza en la autorización que fija como plazo de vigencia para ejecutar la orden judicial de 60 días a partir del 23 de agosto pasado, establece que incluye todas las informaciones que sobre estos existan en el sistema financiero de las entidades supervisadas por estos, tales como movimientos de todo tipo de cuentas y productos, entre otros. Relacionadas a pagos y excepción de impuestos relacionados a 209 personas físicas y jurídicas.

El Ministerio Público investiga al ex ministro de Hacienda, Guerrero, por los “tipos penales preliminares” de asociación de malhechores, falsificación, estafa contra el Estado, sobornos, coalición de funcionarios y lavado de activos.

La investigación abarca a los exfuncionarios Emilio César Rivas Rodríguez, exdirector de Bienes Nacionales, Claudio Silver Peña, exdirector de Catastro Nacional, Luis Miguel Picirillo Mccabe, y Domingo Enrique Martínez Reyes, exmiembro del Consejo Estatal del Azúcar.

Igualmente, Simón Lizardo Mezquita, ex administrador del Banco de Reservas, Luis Baldemiro Reyes Santos, ex director general de presupuestos, Daniel Omar de Jesús Caamaño Santana, ex contralor general de la República, Princesa Alexandra García Medina y Aldo Antonio Gerbasi Fernández, de exmiembro de la dirección de Reconocimiento de Deuda Pública, entre otros funcionarios de instituciones públicas que se encuentran en subordinados al Ministerio de Hacienda.

Asimismo, se identificaron empleados que presuntamente tuvieron participación en los hechos, tal es el caso de Hortensia Arelis Santiago, exanalista de deuda administrativa del Ministerio de Hacienda, Belkis Tejada Ramírez, ex directora jurídica de Bienes Nacionales, quien a la vez era responsable de registro y análisis, Rolando Méndez Morillo, agrimensor de Deuda administrativa, Oscar Ramón Ortiz de la Rosa, quien desempeñó funciones de agrimensor de Deuda Pública, siendo oficialmente el coordinador del Plan Nacional de Titulación de la Dirección de Bienes Nacionales, quien se desempeñaba como asesor de esa entidad.

También se menciona a Rafael Geraldo Collado Ventura, agrimensor de Bienes Nacionales, María Altagracia de la Rosa Hidalgo, encargada de auditoría interna de la contraloría general de la República, Priamo Jiménez Toribio, auditor de la contraloría, William Antonio Castillo Deudas, soporte administrativo de la División de reconocimiento de deudas administrativas, Joaquín Ernesto Tavares Cabral, agrimensor de la división de reconocimiento de deuda administrativa, Wilma Esmeralda Rosario Santana, abogada de dicha división.

¿Cómo fueron hechas las supuestas maniobras fraudulentas?

Sostiene que el modus operandi consistía en que bajo las instrucciones del Ministro de Hacienda, para entonces Guerrero Ortiz, se realizaron maniobras fraudulentas con el objetivo de sustraer del erario público la cantidad de RD$19, 653, 871,513.80 por concepto de acuerdos transnacionales.

Conforme con la pesquisa han identificados que lograron sustraer RD$17,300,642,051.07 por operaciones relacionadas con expropiaciones de terrenos en área protegidas, así como la simulación de compra y venta de terrenos bajo la modalidad de deudas administrativas.

Refiere el ministerio público que el elemento común en todas las transacciones o acuerdos firmados entre las partes, es el relacionado a contratos de cesiones de créditos por más de diez mil quinientos millones de pesos a persona de su entera confianza, que en ocasiones utilizaban sociedades comerciales de carpeta, disolviéndose inmediatamente obtuvieron su objetivo, constituyendo el tipo penal de desfalco.

Aduce que el imputado Guerrero Ortiz, creó una estructura gubernamental compuesta por los investigados Ramón Emilio Jiménez Collie (Mimilo), José Andrés Familia, Femando Crisóstomo Herrera, Álvaro Jiménez Crisóstomo, Efraín Santiago Báez Fajardo, José Pablo Ortiz Giraldo, José Arturo Ureña, Juan Alexander Tapia Holguín.

También Pedro María Altagracia Veras, Bernardo Rafael Ledesma Méndez, Ángel Lockward Mella, Ángel George Lockward Cruz, entre otros, para a través del ministerio de Hacienda, hacer procesos irregulares e ilegales de deuda pública y con ello desfalcar el patrimonio del estado Domiciano.

Precisa el documento que la corroboración del vínculo directo del imputado Guerrero Ortiz con estas personas se verifica en el interrogatorio practicado al señor Bolívar Antonio Ventura Rodríguez, donde se confirma que los mismos en asociación servían a los intereses del ex ministro de Hacienda para la realización de actos ilícitos tendente a desfalcar al Estado.

“Es así, señala el documento, como los miembros de esta estructura de “corrupción” para estafar al Estado maniobrando para obtener montos millonarios, todo bajo manto y protección del exministro de Hacienda, Guerrero Ortiz, quien facilitaba los medios para girar los pagos burlando todo proceso de control administrativo y legal.

Sostiene que la utilidad de la entrega de las informaciones financieras traerá como resultado el intercambio financiero entre ellos, su capacidad financiera, los incrementos patrimoniales, transacciones sospechosas, flujo de dinero y hasta cuentas personales o empresariales, permitiéndole profundizar y robustecer las investigaciones en curso.

Señala que es recurrente que el ex ministro de Hacienda, mediante comunicación le instruya al viceministro del tesoro, Rafael Gómez Medina registrar órdenes de pagos en el Capítulo 999 “Obligaciones del Tesoro, deuda administrativa, por concepto de acuerdos transnacionales a los fines de emitir los libramientos de pagos envueltos en esta investigación».

Destaca que en el informe de investigación realizado por la unidad antifraude de la Contraloría, indica que en la mayoría de los casos se verificaron diversas incongruencias entre los nombres de las personas asentadas como titulares de los derechos afectados por los decretos, y los nombres que figuran en los documentos presentados por los reclamantes para soportar los pagos.

Señala que estos fueron asumidos como errores tipográficos por los técnicos evaluadores de los documentos, sin procurar que dichos errores fueran rectificados a través de los procedimientos establecidos en las leyes por las autoridades competentes, situación que también fue observada en los nombres y apellidos de los servidores públicos actuantes en las diferentes etapas administrativas para el proceso de pago.

Sostiene que continuando con las precisiones del informe, han ido corroborando, a través de otros medios de pruebas, que existen diferencias muy marcadas en relación a los libramientos de pagos que figuran registrados y pagados.

Estas diferencias, se aduce, consisten en que, desde el Ministerio de Hacienda, se pagaron 30 libramientos durante el periódico del 22 de enero al 27 de julio del 2020, por un monto total aproximado de RD$10, 993,120,387.60, en tanto que, la Tesorería Nacional, certifica libramientos por un monto de RD$5,636.093,821.14, para una diferencia de unos RD$6,431,438,750.41.

En este punto se puede establecer que el Ministerio de Hacienda realizó pagos directos sin ser sometidos al proceso de control previo establecido por la Ley 10-07 de control Interno, de la Contraloría.
