ESTA VISA ES PARA TRABAJOS TEMPORALES NO RELACIONADOS CON LA AGRICULTURA
Santo Domingo, RD- El martes el Departamento de Seguridad Nacional estadounidense anunció que República Dominicana estaba incluida entre los seis nuevos países, cuyos ciudadanos son elegibles para participar en los programas de visas H-2B el próximo año.

Este visado, para trabajos temporales no relacionados con la agricultura, contiene una serie de pasos a seguir para que sea aprobado, y dependerá de la demanda existente de empleados extranjeros.
Hay que aclarar que este proceso no solo está en manos de quién aplica para la visa H-2B, sino que gran parte reside en los empleadores estadounidenses.
Esto es porque, según el Departamento de Trabajo de Estados Unidos (DOL, por sus siglas en inglés), quien solicita mano de obra por esta vía debe agotar también varios requisitos.
En el primer paso, el empleador tiene que presentar una solicitud de certificación de empleo temporal para mano de obra extranjera del DOL, y esperar que le entreguen la certificación de empleo temporal para los empleados H-2B.
Luego debe llenar el formulario I-129, un documento de 36 páginas. Una vez completo se debe presentar ante el Servicio de Ciudadanía e Inmigración de los Estados Unidos (USCIS, por sus siglas en inglés), pagando una tarifa de 460 dólares (alrededor de 26,000 pesos).
Finalmente los dominicanos interesados en el programa, luego de que le sean aprobados todos los documentos anteriormente mencionados, solicitan la visa H-2B y posteriormente solicitan admisión a los Estados Unidos a través del Servicio de Aduanas y Protección Fronteriza de ese país, de acuerdo con el USCIS.

Otro tema importante para los solicitantes es que deben demostrar que no hay suficientes trabajadores estadounidenses para realizar el trabajo temporal al que aplicaron.
Asimismo, los empleadores tienen que asegurarle al estado norteamericano que emplear trabajadores H-2B no afectará negativamente los sueldos, ni las condiciones de trabajo del personal local.
Además, debe garantizar que la necesidad de servicios de los trabajadores H-2B es temporal, sin importar las funciones que ejerza.
Estadía
En su página web la USCIS informó que el período de estadía bajo este programa dependerá del contrato del empleado, aunque aclaró que el mismo se puede extender hasta tres años.
Una vez cumplido este tiempo debe salir de los Estados Unidos por tres meses ininterrumpidos, antes de poder aplicar nuevamente para la visa H-2B.
Familia
El cónyuge o hijo menor de 21 años de un empleado H-2B puede solicitar admisión bajo la clasificación de no inmigrante H-34, afirmó la USCIS en su portal.
